Electronic Disclosure and Consent Agreement

By subscribing to or using EmigrantDirect, you agree to the terms of this Agreement. In this Agreement, "you" or "your" refers to the person(s) subscribing to or using EmigrantDirect, "we", "us" or "our" refers to EmigrantDirect and any agent, independent contractor, designee, or assignee EmigrantDirect may, in its sole discretion, involve in the provision of EmigrantDirect.

1. System Requirements
   In order to use EmigrantDirect, you must have an Internet Service Provider (ISP) and a Web browser that supports the level of encryption employed by EmigrantDirect, currently 128-bit. This also requires that you have Acrobat Reader software. If you do not currently have this software, you can download it free at www.adobe.com. EmigrantDirect may change these requirements from time to time. If any of these requirements change, we will provide you with advance notice of the change.
2. Communications and Notices
   Accessing EmigrantDirect via the Internet means you agree to receive electronic communications in connection with these services. These include, but are not limited to:
   
   • All EmigrantDirect agreements and amendments thereto;
   • All service and product disclosures;
   • Monthly statements;
   • Service history and transaction records;
   • Notices;
   • Privacy policies;
   • Responses to claims;
   • All legal, regulatory and other communications related to the service.
3. Delivery
   All communications that we send electronically will be provided either (1) in your secure message center, (2) via your external email, or (3) on our website. This requires that you keep your email address and other contact information contained in your profile up-to-date.
4. Paper Copies
   If you would like a paper copy of any document we provide to you electronically, you may contact us. You may have to pay a fee for the paper copy unless charging a fee is prohibited by applicable law. Please refer to the applicable statement or agreement for any fee that may apply for paper copies. Note that all communications we are required to send to you by law will be downloadable and printer friendly.
5. Consent
   When checking the box "I have read and agree to this electronic disclosure agreement" you indicate your consent to the terms, conditions and responsibilities contained herein. You have the right to withdraw your consent at any time. Please be aware, however, that withdrawal of consent may result in the termination of your access to online banking, and your ability to use our online Products or Services. Your withdrawal of consent will become effective after we have had a reasonable opportunity to act upon it.
